Terms of Service

These terms govern your use of Fivefold AI's services, including SaaS Spend Intelligence and Managed IT, as described on 5foldstrategy.com. By engaging Fivefold AI, you agree to the terms below.

1. Services

Fivefold AI provides two service lines:

• SaaS Spend Intelligence: a monthly FinOps service offered as Self-Service, Visibility, or Optimization, as described on our pricing page at the time you sign up.
• Managed IT: AI-augmented managed service provider offerings for businesses from 5 to 500 seats, as described on our Managed IT page.

The specific scope, deliverables, and pricing for your engagement are those set out in your order form, quote, or the plan you selected at signup.

2. The 90-day savings guarantee

For SaaS Spend Intelligence clients: if Fivefold AI has not identified savings opportunities with a documented, estimated annual value greater than your annual subscription fee within the first 90 days of engagement, you will not be charged the subscription fee for that 90-day period.

"Identified" means the opportunity appears in your monthly Spend Intelligence Report with a stated estimated dollar value. The guarantee covers opportunities identified, not savings actually realized or actioned, since some actions (such as a renewal negotiation) may fall outside your control or outside the 90-day window. This guarantee applies once per client, to the Visibility and Optimization tiers. It does not apply to the Self-Service tier, which is a lower-cost automated reporting product without dedicated analyst review.

3. Fees and payment

Self-Service, Visibility, and Optimization plans are all billed monthly in advance via the payment method on file. There is no revenue-share or contingency-fee option; every plan is a flat recurring subscription.

Fees are quoted in Australian dollars and exclude GST unless stated otherwise.

4. Term and cancellation

Engagements run month-to-month following the initial 90-day guarantee period. Either party may cancel with 30 days' written notice (email to hello@5foldstrategy.com is sufficient). No further fees are payable after the cancellation takes effect, other than fees already accrued.

5. Data access and confidentiality

To deliver the service, Fivefold AI requires read-only access to relevant systems (for example, accounting platforms, SSO/directory logs, and your HRIS where applicable). We will not make changes to your systems without your approval, and we will not share your financial or usage data with any third party, including vendors you are negotiating with, except as needed to deliver the service or as required by law.

6. Your responsibilities

You agree to provide timely access to the systems and information needed to deliver the service, and to review and approve recommended actions in a timely manner. Delays in providing access or approvals may affect our ability to meet the 90-day guarantee.

7. Intellectual property

Fivefold AI retains ownership of its methodology, tools, and report templates. You receive an ongoing licence to use the reports and recommendations we provide you for your internal business purposes.

8. Limitation of liability

To the extent permitted by law, Fivefold AI's total liability arising from an engagement is limited to the fees paid by you in the three months preceding the claim. Fivefold AI is not liable for indirect or consequential losses. Nothing in these terms excludes any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

9. Governing law

These terms are governed by the laws of New South Wales, Australia.

10. Changes to these terms

We may update these terms from time to time. The date at the top of this page reflects the most recent update. Continued use of the service after an update constitutes acceptance of the revised terms.
